This is a release of liability and waiver of legal rights. By signing, you give up the right to sue Puppy & Flow for ordinary negligence and assume the risk of injury, illness, or death from participating with live animals.
The Activity. Puppy & Flow offers recreational puppy yoga classes in Westwood, Los Angeles, in which guests participate in a guided yoga session in the same room as live, unleashed puppies and dogs sourced from rescues and ethical breeders. Guests may not bring their own pets; service animals are accommodated with advance notice.
Inherent risks. I understand that participating involves known and unknown risks including, but not limited to: animal bites (including bites that break skin, cause scarring, infection, or nerve damage), scratches, jumping/knockdowns, allergic and asthmatic reactions, parasites (fleas, ticks, ringworm), zoonotic illness (giardia, kennel cough, leptospirosis, parvovirus, rabies, etc.); yoga-related sprains, strains, fractures, torn ligaments, dizziness, dehydration, cardiovascular events; slipping, tripping, or falling on mats, floors, or stairs; the unique combined risk of practicing yoga with free-moving animals (urination, defecation on mats, animals landing under participants); communicable disease exposure; and property damage to phones, clothing, bags, jewelry, or other personal items. Puppies and dogs are inherently unpredictable — even friendly, well-socialized animals may bite, scratch, or behave unexpectedly.
Express assumption of risk. I voluntarily choose to participate with full knowledge of these risks. I expressly assume all such risks, both known and unknown, and accept full personal responsibility for any injury, illness, disability, death, or loss of or damage to property.
Dog-bite statute waiver. I expressly and knowingly waive any and all rights and claims under California Civil Code § 3342 (strict liability for dog bites) or any analogous statute or common-law strict-liability rule, against the Released Parties, for any bite, scratch, or other animal-caused injury sustained in connection with the Activity.
Release of liability. I, on behalf of myself, my heirs, spouse, children, parents, executors, and assigns, release, waive, discharge, and covenant not to sue Puppy & Flow, its owners, officers, employees, contractors, instructors, volunteers, agents, insurers, sponsors, partner organizations, handlers, foster families, the rescues and breeders supplying the animals, and the studio venue, its owner, landlord, and lessees (collectively, the "Released Parties") from any and all claims, demands, causes of action, and liabilities of any kind, in law or equity, arising out of or related to my participation in the Activity, my presence on the premises, or my interaction with any animal — including claims based on the ordinary negligence of any Released Party. I understand I am giving up substantial legal rights. This release does not cover gross negligence, recklessness, fraud, intentional misconduct, or any liability that cannot be released by law (Cal. Civ. Code § 1668).
Communicable disease. I voluntarily assume the risk of exposure to and contraction of any communicable, contagious, infectious, or zoonotic disease in connection with the Activity, and release the Released Parties from any such claim. I agree not to attend a class if I am or reasonably believe I may be contagious or symptomatic.
Indemnification. I agree to indemnify, defend, and hold the Released Parties harmless from any loss, liability, cost, or expense (including attorneys' fees) arising out of my participation, including claims brought by me, my family, or my estate, and any injury or damage I cause to others, animals, or property.
Health & medical authorization. I represent that I am physically and mentally fit to participate, have no condition that would make participation unsafe (pregnancy, allergy, asthma, recent surgery, cardiovascular disease, seizure disorder, etc.) that I have not already cleared with my physician, and I am not under the influence of alcohol, drugs, or impairing medication. In an emergency, I authorize Puppy & Flow to call 911 and consent to emergency medical treatment on my behalf, at my expense.
Personal property. I bring phones, cameras, bags, clothing, jewelry, mats, and water bottles entirely at my own risk. Puppy & Flow is not responsible for items that are lost, stolen, soiled, chewed, urinated on, or otherwise damaged by an animal or another guest.
Photo & likeness release. I grant Puppy & Flow a perpetual, worldwide, royalty-free, sublicensable license to use my name, likeness, voice, and image (captured in photo, video, or audio) for marketing, advertising, social media, editorial, and promotional purposes, in any medium, without further notice or compensation. I waive any right of publicity or privacy under California Civil Code § 3344 with respect to such use. I may opt out by notifying staff in writing at check-in and wearing the "no photo" indicator provided.
Conduct rules. I will follow all staff instructions, will not pick up or feed animals without permission, will allow puppies to approach me rather than chase or grab them, will not use flash photography, and will not bring food toxic to dogs (chocolate, grapes, xylitol, etc.) into the studio. Puppy & Flow may refuse entry or remove any guest who poses a risk or violates these rules, with no refund.
Minors. If the participant is under 18, this waiver must be agreed to by their parent or legal guardian, who confirms the minor is at least 12, agrees to the accompanying-adult rule for ages 12–15, releases all claims on behalf of themselves and the minor to the fullest extent permitted by California law, and agrees to indemnify the Released Parties for any claim brought by or on behalf of the minor — including after the minor reaches the age of majority.
No insurance. Puppy & Flow does not provide accident, medical, hospitalization, or disability insurance. I am responsible for my own coverage and medical bills.
Shortened limitations period. Any claim arising out of or related to the Activity or this waiver must be filed within one (1) year after the event giving rise to the claim, or it shall be forever barred.
Electronic signature. My electronic signature is the legal equivalent of a handwritten signature under the federal E-SIGN Act (15 U.S.C. § 7001) and the California Uniform Electronic Transactions Act (Cal. Civ. Code § 1633.1 et seq.).
Validity. This waiver is indefinite and applies to all my current and future participation in the Activity until I revoke it in writing or Puppy & Flow publishes a materially updated waiver and requires me to re-sign.
Severability & entire agreement. If any portion is held invalid, the remainder shall continue in full force and effect, reformed to the minimum extent necessary to make it enforceable. This waiver, together with the Terms of Service and Privacy Policy, is the entire agreement.
Governing law & venue. This waiver is governed by California law. Any dispute shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and I consent to that personal jurisdiction and venue.
Acknowledgment. By checking the agreement box and signing below, I acknowledge that I have read this entire waiver, understand it, had the opportunity to consult an attorney, am at least 18 or the parent/guardian of the participant, and am signing freely and voluntarily.
